TenderWinnow beta terms

1. Who we are

TenderWinnow is a business tender-filtering service operated by NAVENE LABS LIMITED (company number 17350926) from 98 Woodford Lane, Cheshire, CW7 2JU. Contact us at navenelabs@gmail.com.

2. The service

TenderWinnow uses automated and AI-assisted techniques to compare a business capability profile with public procurement notices. It provides ranked suggestions, explanations and risk signals to help a business decide which opportunities to investigate.

TenderWinnow does not submit bids, inspect every procurement document, provide legal or procurement advice, guarantee eligibility or guarantee that a customer will win work. The linked notice and procurement documents remain the source of truth. Customers must verify requirements, deadlines and suitability before acting.

The service is in beta. Features, sources and matching methods may change. We will take reasonable care to keep the service available and accurate, but continuous or error-free availability is not guaranteed.

3. Business use and accounts

TenderWinnow is offered for business use. The person creating an account confirms that they are authorised to act for that business and that the account information they provide is accurate. Account credentials and sign-in codes must be kept secure, and suspected unauthorised use must be reported promptly.

Nothing in these terms excludes rights that cannot lawfully be excluded. If a customer is legally acting as a consumer, mandatory consumer protections continue to apply.

4. Plans, prices and payment

The Free plan is £0. During beta, the available paid Starter plan is £39 per month or £390 per year. Pro is not available for purchase. NAVENE LABS LIMITED is not currently VAT registered and does not charge VAT. If that status changes, the price and tax treatment shown before purchase will apply prospectively.

Stripe hosts Checkout, receipts and subscription management. TenderWinnow does not receive full payment-card details. A paid subscription starts when Stripe confirms payment and renews automatically for the same billing period until cancelled. The price and renewal interval are shown before purchase.

5. Cancellation and refunds

Customers can cancel at any time through Stripe's customer portal. Cancellation stops the next renewal; access continues until the end of the already-paid billing period.

Monthly subscriptions: amounts already paid are not normally refundable or prorated. We will refund a duplicate or incorrect charge, a period in which the paid service was materially not provided, or any amount that applicable law requires us to refund.

Annual subscriptions: a customer may request a full refund within 14 days of the first annual purchase or an annual renewal. After that 14-day period, amounts already paid are not normally refundable or prorated, except for a duplicate or incorrect charge, a period in which the paid service was materially not provided, or any amount that applicable law requires us to refund.

Refund requests should be sent to navenelabs@gmail.com with the account email and Stripe invoice or receipt reference. Customers should not send card or bank details by email.

6. Customer responsibilities

Customers must not use TenderWinnow unlawfully; attempt to bypass access, usage or security controls; interfere with the service; introduce malicious code; scrape or resell the service contrary to documented access; or submit confidential, special-category or unnecessary personal data in capability profiles or feedback.

Customers are responsible for their tender decisions, bid content, regulatory compliance and dealings with contracting authorities.

7. Intellectual property and public-source content

NAVENE LABS LIMITED and its licensors retain rights in TenderWinnow, including its software, design and original content. Customers retain rights in information they enter and permit us to process it only to operate, secure and improve the service as described in the privacy notice.

Procurement notices and linked documents belong to their respective publishers or rights holders. Links and summaries do not transfer ownership or replace the original material.

8. Suspension and termination

We may suspend or terminate access where reasonably necessary to address unlawful use, security risk, non-payment or a material breach of these terms. Where practical, we will provide notice and an opportunity to remedy the issue. A customer may stop using the Free plan and request account deletion at any time.

9. Liability

Neither party excludes liability that cannot lawfully be excluded, including liability for fraud, fraudulent misrepresentation, or death or personal injury caused by negligence.

Subject to that, NAVENE LABS LIMITED is not liable for indirect or consequential loss, lost profit, lost opportunity, bid-preparation cost, or decisions based on a tender suggestion. For paid service claims, our total liability arising in any 12-month period is limited to the fees paid for TenderWinnow in that period. For the Free plan, total liability is limited to £100. These limits do not reduce any mandatory rights.

10. Changes

We may change these terms or the service. Material changes affecting a paid subscription will be communicated before they take effect. If a material change is unacceptable, the customer may cancel before the next renewal.

11. Law and disputes

These terms are governed by the law of England and Wales. The courts of England and Wales have jurisdiction, subject to any mandatory jurisdictional rights that apply. Please contact navenelabs@gmail.com first so we can try to resolve a complaint promptly.
